XstreamTV – Terms and Conditions of Service

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and XstreamTV (“XstreamTV,” “we,” “us,” or “our”) governing your access to and use of our website, services, applications, and content (collectively, the “Services”).

XstreamTV does not guarantee uninterrupted, timely, secure, or error-free operation of the Services. Service availability may be affected by factors outside our control, including but not limited to internet connectivity, device compatibility, maintenance, or third-party service providers.

3. User Obligations

You agree to:

• Use the Services solely for personal, non-commercial purposes;
• Maintain the confidentiality of your account credentials and not share access with third parties;
• Limit usage to a single household unless expressly authorized in writing by XstreamTV;
• Comply with all applicable laws, regulations, and these Terms; and
• Refrain from any activity that interferes with or disrupts the Services or infrastructure.

XstreamTV reserves the right to suspend or terminate access if a violation is suspected or confirmed.

4. Prohibited Conduct

You shall not, directly or indirectly:

• Resell, sublicense, distribute, or exploit the Services or content for commercial purposes;
• Reverse engineer, decompile, disassemble, or attempt to derive source code or proprietary technology;
• Circumvent security features or access unauthorized areas of the Services;
• Upload, transmit, or distribute content that infringes intellectual property rights or violates applicable laws;
• Engage in conduct that may damage, disable, overload, or impair XstreamTV’s systems or networks.

Violations may result in immediate termination and potential legal action.

5. Intellectual Property Rights

All content, trademarks, logos, software, designs, text, graphics, and media available through the Services are the exclusive property of XstreamTV or its licensors and are protected by applicable intellectual property laws.

No rights or licenses are granted to you except as expressly stated herein. Unauthorized use may result in civil and criminal liability.

6. Modifications to Services and Terms

XstreamTV reserves the right to modify, suspend, or discontinue any aspect of the Services, and to amend these Terms, at any time without prior notice.

Revised Terms will be effective upon posting. Continued use of the Services after such changes constitutes acceptance of the revised Terms.

7. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, XstreamTV disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, XstreamTV shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of the Services.

Your sole remedy for dissatisfaction with the Services is to discontinue use.

9. Indemnification

You agree to indemnify, defend, and hold harmless XstreamTV, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.

10. Termination

XstreamTV may suspend or terminate your account and access to the Services at its sole discretion, with or without notice, for any reason.

Termination does not relieve you of payment obligations incurred prior to termination.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles. You agree that any dispute shall be subject to the exclusive jurisdiction of the courts of Canada.

12. Dispute Resolution

Prior to initiating formal legal proceedings, the parties agree to attempt to resolve disputes informally. If resolution cannot be reached, disputes may be resolved through binding arbitration or litigation, at XstreamTV’s discretion, subject to applicable law.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
